Because Cast 2 Crew Pty Ltd provides immediate digital valueโincluding entry into trade promotions (giveaways), access to proprietary partner rewards, and digital profile curation servicesโwe maintain a strict policy regarding refunds. By purchasing a membership, upgrade package, or booster, you provide express deemed acceptance of these terms.
1. No Refunds for "Change of Mind"
In accordance with Section 2.5 of our core Terms and Conditions, all sales are final. All payments, including one-time upfront Founding Member fees and one-off Upgrade Packages (Bronze, Silver, Gold, Platinum/Diamond), are non-refundable for a change of mind.
Immediate Value Delivery: Upon payment, you receive instant access to the Rewards Club "Custom Blueprint" and are immediately recorded in our secure entry database for active draws. As this digital value is bundled and delivered the moment the transaction is complete, the service is legally deemed "consumed." This model prevents system exploitation where entries are acquired for a specific draw cycle and a refund is sought post-announcement.
Professional Outcomes: As a promotional publication platform (not a licensed talent agency), we do not guarantee employment, auditions, or commercial success. A lack of professional work secured through the directory is not grounds for a refund.
2. Australian Consumer Law (ACL) Compliance
Nothing in this policy excludes, restricts, or modifies your non-excludable rights, consumer guarantees, or remedies under the Competition and Consumer Act 2010 (Cth).
Major Failures: While we do not refund for "change of mind," you are entitled to a remedy under the ACL for a "major failure" of service that cannot be rectified by us within a reasonable administrative timeframe.
Proportionality: To the extent permitted by law, our liability for any breach of a non-excludable consumer guarantee is strictly limited, at our absolute discretion, to the re-supply of the services or covering the cost of having the services supplied to you again.
3. Account Closures & Founding Member Forfeiture
Voluntary Closure: Because core memberships (such as the Founding Member tier) are structured as lifetime access vehicles with a one-off upfront payment, there are no ongoing subscription billing cycles to cancel. Members may request the voluntary permanent closure and deletion of their account at any time, but no pro-rata or partial refunds of the historical upfront fee will be issued.
Forfeiture of Perks: Per Section 2.1 of our Terms and Conditions, if an account is voluntarily closed by the member, or permanently terminated by Cast 2 Crew for cause (including, but not limited to, public disparagement, submission of false credentials, or behavioural misconduct), the "Founding Member" status and its associated perpetual perksโincluding the three (3) free recurring giveaway entriesโare permanently forfeited and cannot be recovered upon any subsequent re-registration.
4. Upgrade Packages & Split Lifecycle Expiry
Benefits derived from one-off Upgrade Packages carry distinct, non-refundable expiration parameters based on their administrative and regulatory nature:
Complimentary Giveaway Entries (The Calendar Year Rule): Per Section 2.2(a) of the Terms, all promotional or package-derived giveaway entries expire automatically at 11:59:59 PM AEST on December 31st of the calendar year in which they were purchased. Unused or unspent entries do not roll over and are permanently cleared. The conclusion of a calendar year compliance cycle does not grant a right to a partial or pro-rata refund.
Editorial Amendment Credits (The 12-Month Rule): Editorial amendment credits included in any package carry a lifespan of twelve (12) months (365 days) from the exact date of purchase. No refunds, extensions, or cash credits are issued for unused credits remaining on the account at the time of expiry.
5. Declined Content & Termination for Cause
Curation Standards & Rejection: Cast 2 Crew operates as a curated profile publication service and reserves absolute editorial discretion over what is published to our public directory (Section 4.4 of the Terms). If submitted media materials fail to meet our basic quality, formatting, or safety standards, we will request revisions. If a submission cannot be successfully curated due to an internal platform restriction prior to a public profile being constructed, a refund may be issued at our sole discretion.
Member Breach: No refunds under any circumstances will be issued if an account is suspended, restricted, or permanently terminated due to a material breach of our Terms and Conditions, including providing fraudulent credentials, violating our intellectual property restraints, or breaching our Zero-Tolerance Abuse Policy (Section 12 of the Terms).
6. Chargeback Protection & "Friendly Fraud" Prevention
We employ advanced system logging to track account creation timestamps, onboarding progression, user login activity, support interactions, and digital material submissions.
Proof of Delivery: You acknowledge and agree that these comprehensive system logs constitute definitive, binding "Proof of Delivery" of our digital services to your financial institution in the event of a commercial dispute.
Automatic Revocation: If a chargeback or payment dispute is initiated with your bank, your directory profile, platform access, and all current or future giveaway eligibility will be permanently revoked and blacklisted, regardless of the bank's final internal assessment outcome.
Mandatory Resolution Protocol: You agree to contact admin@cast2crew.com to resolve billing questions or suspected duplicate charges before initiating a dispute with your bank. Bypassing this protocol to execute "friendly fraud" or force unauthorized reversals constitutes a material breach of contract.
7. Billing Errors & Rectification
If you suspect a duplicate charge or a processing error due to an automated technical system glitch, you must notify us at admin@cast2crew.com within seven (7) days of the transaction timestamp. If an internal system or gateway error is verified upon technical review, we will promptly credit or rectify the miscalculated charge back to the original payment source.
